2 October 2026 — Three regulators in South America have consultations open that close in the next few weeks. Each shapes rules that technology companies in those markets will live with for years.
Not yet independently verified. Anatel gives the comment period only as 45 days from the notice in the official gazette of 8 September 2026, which we count to about 23 October; the exact closing day is in the notice, which we have not read. The Paraguay item rests on DPL News; Conatel’s draft plan itself was not opened. We will update this when it can be confirmed, and remove this note.
Brazil: ANPD’s inspection and sanctions rules, to 26 October
Brazil's National Data Protection Authority (ANPD) is rewriting its inspection and administrative sanctions regulation (Resolution CD/ANPD No. 1/2021). The update reflects the ANPD's new responsibilities, including the online protection of children and adolescents, duties of digital platforms, and the protection of women in digital environments, and its new status as a regulatory agency. Contributions are open on the Brasil Participativo platform until 26 October 2026. This regulation sets how the ANPD investigates and how it decides penalties under the LGPD, so every company processing personal data in Brazil has a stake in it.
Brazil: Anatel’s upper 6 GHz auction, with data-centre commitments
Anatel has put the draft notice for auctioning the upper 6 GHz band (6,425 to 7,125 MHz) to public consultation (Consulta Pública No. 37). It offers 700 MHz in national and regional lots, with the auction planned by 2028. Among the obligations proposed for winners is a Regional Digital Infrastructure Commitment: neutral regional data-centre hubs and edge data centres in the North, Northeast and Centre-West, with open and non-discriminatory access. Comments go through the Participa Anatel platform within 45 days of the gazette notice of 8 September.
Paraguay: national telecoms plan 2026–2030, to 15 October
Paraguay's regulator Conatel published its draft National Telecommunications Plan 2026–2030 on 1 October, open for comment until 15 October 2026. According to DPL News, its 2030 targets include fibre backbone in 265 districts, 95.6% 4G and 30% 5G population coverage, and average mobile speeds of 35 Mbps down and 15 Mbps up.
